Texas Presses RadioShack on Plan to Auction Customer Data

New York, 4/17/2015 (CRM) -- The following is an excerpt from a story published by the Dow Jones Daily Bankruptcy Review:

Texas Attorney General Ken Paxton says a plan to sell the RadioShack Corp. name and customer lists jeopardizes the privacy promises made during the decades when the company pioneered the field of consumer electronics retailing.

Mr. Paxton said he and other attorneys general have been ignored by RadioShack as it plans an auction of intellectual property. State officials have voiced concern that nothing untoward happen to the consumer data in RadioShack’s bankruptcy case. Customers gave up the information on the promise it wouldn’t be rented or sold, the attorneys general noted, yet that’s what RadioShack plans to do.

A RadioShack lawyer and a spokeswoman didn’t respond to a request to respond to the critique. Salus Capital Partners, the lender with first claim on the intellectual property assets, didn’t respond.

A consumer privacy ombudsman was appointed early in RadioShack’s bankruptcy, to make sure consumer rights are protected. Elise Rejka is expected to file a report and recommendations after the intellectual property auction is held.

Generally, bankruptcy courts allow consumer data to be sold as part of the sale of a business, as long as the new owner agrees to abide by the privacy policy that was in effect when customers surrendered their information.

Mr. Paxton’s court papers say the auction plan creates a danger to RadioShack’s customers. He’s asking the company to spell out in detail how many customers could be affected and to say whether the information came from the website or the bricks-and-mortar operation.

Additionally, the attorney general wants to require prospective bidders on the intellectual property bundle to say how much of the price they’re offering is for the customer data.

A bankruptcy judge must sign off on proposed rules for the bidding on a collection of assets that includes the iconic name, as well as contact information for an estimated 67 million people who shopped at RadioShack. A hearing is scheduled near the end of April on the bid rules.
